The purpose of the www.agatehyggeetcosy.com website is to offer for sale mainly home decoration and well-being products (hereinafter referred to as “Products” or “items”) exclusively to consumer and non-professional buyers.
All purchases of items on the www.agatehyggeetcosy.com e-commerce site are subject to the present General Terms and Conditions of Sale (“GTCS”).
Prior to placing an order, the purchaser declares that he/she has full legal capacity to enter into commitments under these general conditions of sale.
ART.1 – PURPOSE
The purpose of these general terms and conditions of sale is to define the rights and obligations of the parties arising from the online sale of the products offered on the site, exclusively for the purposes of the relationship they establish on the Internet.
These terms and conditions apply to online sales in Europe, to the exclusion of any other document, whether the buyer is a professional or a consumer.
The sale is concluded in French/English.
ART. 2 – PRODUCTS/PRICES
- Products: the products offered for sale by the seller are those shown on the site on the day of consultation by the user, subject to availability. Each product is accompanied by a description drawn up by the supplier. The photographs in the catalog are as accurate as possible, but cannot guarantee perfect similarity with the product offered, particularly with regard to colors. These products and services are offered while stocks last. If, despite its best efforts, all or part of the items are unavailable, the seller will inform the buyer by email as soon as possible and offer the buyer the option of waiting or cancelling the order of the unavailable items at no charge. Available items will be delivered as usual.
- Prices: prices are quoted in Euros, and are valid for Belgium, France, Luxembourg, Germany and the Netherlands. They take into account any discounts and VAT applicable on the day the order is placed. The prices applicable to the order are those in force at the time of order confirmation.
- The condition of the packaging and the goods will be checked by the purchaser on delivery and any damage will be reported to Agate Maison d’Hôtes(steph@agateethyggecosy.com) as soon as possible after receipt of the delivery.
ART. 3 – ORDER REGISTRATION AND VALIDATION
Buyers wishing to purchase a product or service must :
- fill in the identification form with all the contact details requested;
- fill in the online order form giving all the references of the products or services chosen;
- confirm your order after checking it;
- make payment in accordance with the conditions set out ;
- confirm your order and payment.
All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will constitute signature and acceptance of the operations carried out.
The seller will send confirmation of the registered order by e-mail.
ART. 4 – DELIVERY
The products ordered by the purchaser will be delivered to the address provided by the purchaser at the time of ordering. The goods are transported at the seller’s risk until they are delivered to the delivery address specified by the buyer. From that moment on, the buyer assumes sole risk.
Delivery charges are payable by the customer and are not included in the price of the products. They vary according to delivery method, order weight and destination.
Shipments are made to Belgium, Luxembourg, France, Germany and the Netherlands via Mondial Relay at home or in a relay point according to their current rates.
Delivery costs are indicated when the order is finalized.
SHIPPING
All orders placed on the site are dispatched by us within 6 working days of the order being placed.
You will always receive an order confirmation by email: please check your “junk mail” box.
Shipping costs are valid for all orders up to 10kg. For larger orders, please contact us at steph@agatehyggeeetcosy.com
For deliveries outside the above-mentioned areas, please contact us via steph@agatehyggeetcosy.com for a customized quotation.
ART. 5 – EXCHANGE POLICY
Our policy lasts 14 days. If more than 14 days have elapsed since your purchase, we are unfortunately unable to offer refunds or exchanges.
In order to be returned, your item must be unused and in the condition in which you received it. It must also be in its original packaging.
To complete your return, we require a receipt or proof of purchase.
Once your return has been received and inspected, we will send you an e-mail to let you know that we have received the returned item. We will also let you know if your refund is approved or declined.
If approved, your refund is processed and your original credit card or payment method is automatically credited within a few days.
Delayed or missing refunds (if any)
If you have not yet received a refund, please check your bank account first.
Then contact your credit card company, as it may take some time for your refund to be officially posted.
Then contact your bank. The posting of a refund is often preceded by a processing time.

Sale or promotional items (if applicable)
Only full-price items are refundable. Unfortunately, sale and promotional items are not.
Shipping
To return your product, you must send it to the following postal address: Rue Derrière Coronmeuse 8 – 4040 HERSTAL
You are responsible for all shipping costs associated with the return of your item. They are non-refundable. If you receive a refund, the cost of return shipping will be deducted.
Depending on where you live, the time taken to receive your exchanged product may vary.
If you are shipping an item worth more than €75, we recommend that you use a tracking service or have your shipment insured. We do not guarantee that we will receive the returned item.
Art. 6 – PAYMENT
To pay for his order, the buyer has the following methods of payment:
- Bancontact
- Visa
- Mastercard
They are also indicated when the order is placed.
Online payment enables the buyer to pay for his order via the Stripe platform, in a secure environment. The order validated by the buyer will not be considered final until the bank payment center has validated the transaction.
AGATE Maison d’Hôtes reserves the right to cancel or suspend any order and/or delivery in the event that the buyer’s bank refuses to authorize payment by credit card or in the event of an existing commercial dispute with the buyer.
All orders are subject to a contribution to the shipping costs mentioned in art. 2.
Items ordered remain the exclusive property of AGATE Maison d’Hôtes until full payment of the order by the buyer.
ART. 7 – CLAUSES APPLICABLE TO PERSONAL DATA
The buyer’s personal data is processed in accordance with the law of December 8, 1992 on the protection of privacy with regard to the processing of personal data.
All personal data provided by the purchaser will be treated as confidential and will only be stored and processed within the framework of the relationship between the purchaser and our company. They will not be sold or made available to third parties without the prior agreement of the purchaser. Data may, however, be transmitted to a partner involved in our legal obligations or in the processing of the transaction with the buyer (for example: our accountant, our supplier, a subcontractor, etc.).
We undertake to take the best possible security measures to prevent unauthorized third parties from gaining access to personal data communicated to us by the purchaser.
The purchaser always has the possibility of knowing what personal data is in our possession and of requesting that it be modified or deleted in order to comply with our legal obligations regarding the retention of data relating to commercial transactions. ART.8 – INTELLECTUAL PROPERTY
All elements of www.agatehyggeetcosy.com are and remain the exclusive intellectual property of www.agatehyggeetcosy.com.
No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio.
Any single link or hypertext link is strictly forbidden without the express prior written consent of the seller.
ART.9 – MISCELLANEOUS
- Liability: In the event of non-performance, AGATE Maison d’Hôtes may not be held liable if the non-performance or improper performance of the sales contract is attributable either to the purchaser or to the unforeseeable and insurmountable act of a third party unrelated to the sale, or to a case of force majeure. In addition, AGATE Maison d’Hôtes cannot be held responsible for any direct or indirect damage resulting from the use of the item sold. AGATE Maison d’Hôtes is in no way responsible for interruptions in access to its site and the consequences that may result.
- Force MajeureForce majeure: the seller shall not be liable for the total or partial non-performance of its obligations under this contract, if such non-performance is caused by an event constituting force majeure, in particular the presence of computer viruses, in the event of disruption or total or partial strike, in particular of the postal services and means of transport and/or communications, flood, fire, etc. Events meeting the criteria laid down by case law will be considered as force majeure.
- Partial invalidity: If one or more clauses of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, all other clauses shall remain valid.
- Entire contract: these general terms and conditions of sale and the order summary sent to the buyer form a contractual whole and constitute the entire contractual relationship between the parties. In the event of any contradiction between these documents, the general terms and conditions of sale shall prevail.
- Modification of the General Terms and Conditions of Sale: Any modification of the General Terms and Conditions of Sale is enforceable against the purchaser within 72 hours of their publication online.
- Applicable law – Jurisdiction: these general terms and conditions of sale and the contractual relationship between the seller and the buyer are governed by Belgian law. In the event of a dispute, the courts of the judicial district of the seller’s registered office shall have exclusive jurisdiction, unless otherwise provided by mandatory public policy. The European Online Dispute Resolution (ODR) platform is provided by the European Commission to make online shopping safer and fairer by providing access to quality dispute resolution tools. This platform is accessible via http://ec.europa.eu/odr.
- Legal guarantee of conformity of goods: Mahalo SRL is bound by the legal guarantee of conformity of consumer goods and is liable to the buyer for any lack of conformity that appears within two years of delivery of the goods.

General conditions of sale – Maison d’Hôtes
The www.agatehygge etcosy.com guest house offers accommodation rentals and rentals for private or corporate events.
All reservations for overnight stays on the www.agatehyggeetcosy.com e-commerce site are subject to these General Terms and Conditions of Sale (“GTCS”).
Prior to booking, the Hirer declares that he/she has full legal capacity to enter into commitments under these terms and conditions of sale.
RESERVATION
The purpose of these general conditions of sale is to define the rights and obligations of the parties arising from the reservation of overnight stays in the guest house offered on the site, exclusively on account of the relationships they establish on the Internet network.
The reservation will be effective after full payment of the nights as well as the supplements.
Booking implies acceptance of these terms and conditions by the customer, who must expressly state that he has read them.
All reservations are by name only and may not be transferred or sublet.
ARRIVALS AND DEPARTURES
In order to be able to welcome you in the best conditions, your reception will start at 3pm.
A key box service is also available if we are unavailable at the time of your arrival. The code will be sent to you on the day of your arrival.
The guest must ensure that the main entrance door to the guest house is kept locked at all times.
He will also ensure that the lights in the main entrance hall and outside are switched off.
Parking is permitted in the driveway in front of the main entrance during loading/unloading only for the shortest possible time. Vehicles will then be parked in the surrounding streets free of charge for the rest of the stay.
On the last day of your stay, departure must be no later than 11am. This ensures that we have the time we need to offer you the best possible comfort.
Under no circumstances may the customer claim the right to remain in the premises beyond the duration of the stay.
TENANTS AND EXTERNAL VISITORS
We rent our accommodation to you for the precise number of holidaymakers stated in the rental contract.
If you wish to welcome visitors during your stay, please ask for our prior agreement.
- Guests not included in the booking are not allowed to sleep on site without extra charge. (see overnight/convivial rates)
- The total number of occupants must not exceed 6. (unless otherwise requested by e-mail steph@agate-cosy.com)
- The customer agrees not to take any photographs without the permission of his hosts. Under no circumstances may any photos taken inside or outside be used for public or commercial purposes, or published on the Internet.
PARTIES AND EVENTS IN THE RENTAL AREA
- Parties, events and large gatherings are not permitted for overnight rentals.
- Commercial filming and other professional uses are strictly forbidden on the property (rentals for private or professional events are by compulsory request and are subject to acceptance).
USE OF PREMISES AND RESPECT FOR EQUIPMENT
- During the entire stay, the tenant must respect the premises. He/she will make good use of the equipment and maintain the accommodation to leave it in perfect condition.
- Dishes must be washed, wiped and stored in the kitchen cupboards as on arrival.
- In the event of accident or breakage, it is your responsibility to inform the owners before departure.
GENERAL SAFETY INSTRUCTIONS
- As a host, we cannot be held responsible for theft, loss or damage to the accommodation if it is not properly locked (windows + entrance doors locked).
- Please ensure that indoor/outdoor lights are switched off at night or when you leave.
- When you’re away, don’t leave any electrical or household appliances on. The house is equipped with smoke detectors.
- Agate Maison d’Hôtes is a non-smoking area. Smoking and vaping are prohibited inside the accommodation. Ashtrays are available for outside use if required. Please do not leave cigarette butts in the garden or on the terrace.
- The customer will strictly respect the private areas of the house or estate.
PETS
Dogs are allowed in our accommodation. (2 maximum per stay). Nevertheless, a few rules must be observed to ensure the cleanliness and serenity of the premises.
- Do not allow pets to climb onto sofas or beds.
- holidaymakers are responsible for cleaning up after their pets (complete removal).
- Pets are welcome, as long as they don’t cause any noise pollution.
- Do not leave your pet unattended at the rental location.
CANCELLATION
Cancellation by the customer :
All cancellations must be notified by e-mail to the owner.
In the event of cancellation 15 days before the date of arrival, the entire payment will be retained by the owner.
Cancellation by the owner:
If the owner cancels your stay, the customer will be reimbursed for the sums paid by bank transfer to the IBAN number provided by the customer. No form of compensation can be claimed.
Any damage to the owner’s property must be reported immediately to the owner. The customer is responsible for repairing the damage and for all ancillary costs, including legal costs.
In the event of damage or theft, the owner reserves the right to take legal action.
In the event of non-compliance with the house rules, the host reserves the right to expel the customer, without the latter being entitled to claim any reimbursement or compensation.
